Microsoft’s recent court appearances are demonstrating that when it comes to data privacy, courts are giving the benefit of the doubt to law enforcement. The Court’s recent decision that territorial borders do not exclude data from the scrutiny of the law means organizations are now at a heightened liability risk for their stored information kept in data centers outside the United States.
